Welcome to Hyzen (“Hyzen,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, including any content, functionality, products, and services offered through our online store (collectively, the “Services”).

By visiting, browsing, or purchasing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1) Eligibility and Account Security

You must be at least the age of majority in your jurisdiction to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and all activity under your account. You may not transfer or assign your account to any other person.

2) Health and Product Information Disclaimer (Dietary Supplements)

Hyzen products are intended for general wellness and hydration support. The information on the Services is provided for educational and informational purposes only and is not medical advice. Always consult a qualified healthcare professional before starting any dietary supplement or significantly changing fluid or sodium intake—especially if you have a medical condition or take medications.

FDA Disclaimer (if applicable): Statements about dietary supplements have not been evaluated by the Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

3) Product Information and Availability

We make reasonable efforts to display products accurately. However:

  • Colors and appearance may vary by device and settings.

  • We do not guarantee that product appearance or packaging shown on the Services will precisely match delivered items.

  • Product descriptions, ingredients, and availability may change without notice.

  • We may limit quantities per order or per customer, and we may discontinue products at any time.

4) Orders; Acceptance; Cancellations

When you place an order, you are making an offer to purchase. We reserve the right to accept, reject, or cancel an order in our sole discretion (including for suspected fraud, errors in pricing, inventory limitations, or shipping constraints).

Your order is not accepted until we confirm acceptance and payment is processed. Review your order carefully before submitting. If you need to request a cancellation, contact us immediately; once an order is processed or shipped, we may be unable to cancel.

5) Pricing; Taxes; Promotions

Prices and promotions may change without notice. The price charged is the price shown at checkout at the time you place the order. Unless otherwise stated, prices do not include taxes, shipping, handling, customs, or import fees.

Promotions may be subject to separate terms. If promotional terms conflict with these Terms, the promotional terms control.

6) Shipping; Delivery; Risk of Loss

Shipping timelines are estimates and not guaranteed. We are not responsible for delays due to carriers, weather, customs, or events beyond our control.

Risk of loss and title pass to you upon transfer of the products to the carrier, except where prohibited by law.

7) Returns and Refunds

Returns, exchanges, and refunds are governed solely by our Refund Policy, which is incorporated by reference into these Terms.

8) Subscriptions and Recurring Purchases (Subscribe & Save)

If you purchase a subscription or recurring order:

  • You authorize us (and our payment processor) to charge your payment method on a recurring basis at the frequency you select (e.g., every 30 days), until you cancel.

  • Subscription pricing, discounts, and product availability may change; we will provide notice when required by law.

  • You can manage, skip, pause, or cancel your subscription via your customer account portal or by contacting support before your next scheduled billing date.

  • If a payment fails, we may retry the charge. If we cannot process payment, your subscription may be paused or cancelled.

9) Intellectual Property

The Services and all content (including trademarks, logos, text, graphics, images, videos, and the arrangement thereof) are owned by Hyzen or our licensors and are protected by intellectual property laws.

You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, or exploit any portion of the Services without our prior written consent.

10) Optional Tools and Third-Party Services

We may provide access to third-party tools or services. We do not control and are not responsible for third-party tools, websites, or services. Your use of third-party services is at your own risk and subject to the third party’s terms.

11) Third-Party Links

The Services may include links to third-party websites. We are not responsible for third-party content, policies, products, or practices. If you access third-party sites, you do so at your own risk.

12) Relationship with Shopify

Hyzen is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Hyzen. Shopify is not responsible for any aspect of any sales between you and Hyzen, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Hyzen.

14) Feedback and User Content

If you submit reviews, comments, suggestions, ideas, or other content (“Feedback”), you grant Hyzen a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose, including commercial purposes, subject to applicable law.

You represent that you have the rights needed to submit Feedback and that it does not violate any third-party rights or applicable laws.

15) Errors; Inaccuracies; Corrections

We may correct errors or omissions (including pricing, descriptions, promotions, shipping charges, or availability) and may cancel orders when information is inaccurate, even after an order is submitted.

16) Prohibited Uses

You agree not to misuse the Services, including by:

  • Violating laws or regulations;

  • Infringing intellectual property rights;

  • Harassing, defaming, or harming others;

  • Transmitting malicious code, scraping/crawling in a manner that harms the Services, or attempting to bypass security features.

We may suspend or terminate access for violations.

To the fullest extent permitted by law, Hyzen (and our affiliates, officers, directors, employees, agents, and service providers) will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or replacement costs, arising from or related to your use of the Services or products.

In jurisdictions that do not allow certain limitations, liability will be limited to the maximum extent permitted by law.

20) Indemnification

You agree to indemnify and hold harmless Hyzen and Shopify (and their affiliates and service providers) from claims arising out of your breach of these Terms, violation of law, or misuse of the Services.

21) Governing Law; Venue

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law rules.

You agree that any dispute will be brought exclusively in the state or federal courts located in Terrebonne, Louisiana, and you consent to personal jurisdiction and venue in those courts.

22) Headings

Headings are for convenience only and do not affect interpretation.

23) Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Services. Changes take effect on the “Last Updated” date, and your continued use of the Services constitutes acceptance of the updated Terms.
